Thota Anantha Lakshmi , Varalakshmi v. State Of Andhra Pradesh,
HONOURABLE SRI JUSTICE P. KESHAVA RAO WRIT PETITION No.1568 OF 2014 ORDER:
There is no representation on behalf of the petitioners. 2.
The prayer sought in the writ petition is as under: " For the reasons stated in the accompanying affidavit, it is hereby prayed that this Court may be pleased to issue a Writ of Mandamus or any other appropriate Writ, order, or direction declaring the impugned action of the respondents particularly the 3rd and 4th respondents in involving themselves into the family disputes of the petitioners by way of their attempt through their constables on 11.01.2014 and attempted to drag out the petitioners from their house bearing No 10-241, Plot No. 118, New Gayatri Nagar, Jillelaguda, Hyderabad at the active instance of the 5th respondent as illegal, arbitrary and violative of principles of natural justice and consequently direct the 2nd respondent to cause protection to the petitioners and to take appropriate action against the 3rd and 4th respondents for their colluding hands with the 5th respondent and harassing the petitioners by way of interfering in their normal life and pass an appropriate order and pass such other order or orders as deemed fit and proper in the circumstances."
3.
3rd respondent-police filed counter-affidavit denying the averments made in the affidavit filed in support of the writ petition and contended inter alia that no complaint whatsoever is received or registered against the petitioners on the file of Meerpet, Police Station and therefore, summoning of the petitioners to the police station does not arise.
4.
From the averments made in the affidavit, it appears that there are civil disputes between the petitioners and the 5th respondent for which the respondent-police have nothing to do with it. It is also specifically stated that the respondents 3 and 4 never sent any constable to the residence of the petitioners and asked them to come to the police station. They never interfered in the civil disputes
much less the dispute of the petitioners. On mere apprehension that in the event of lodging any complaint against them, the present writ petition is filed to prevent the police from taking any action. 5.
In that view of the matter, this Court is of the opinion that there are no merits in the writ petition and the same is liable to be dismissed.
6.
Accordingly, the writ petition is dismissed. There shall be no order as to costs.
Miscellaneous petitions, if any, shall also stand dismissed. ___________________ P. KESHAVA RAO, J Date:27.09.2019.
