THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.38646 OF 2016 ORDER:

The writ petition is filed by the petitioner seeking a writ of mandamus directing the respondents 1 to 3 to provide all requisite and necessary police aid to the petitioner from the unlawful interference of the fourth respondent and his family members with the peaceful possession and enjoyment of the petitioner's property in land bearing survey No.224, admeasuring Acs.3.25 guntas situated in Dilawarpur Village and Mandal, Nirmal District, for the enforcement of the rule of law and adherence to the order, dated 19.10.2016 passed in I.A.No.349 of 2016 in O.S.No.113 of 2016 on the file of the Hon'ble Junior Civil Judge, Nirmal. Heard and perused the material.

Learned counsel for the petitioner submits that the respondents 1 to 3 are not providing police protection to implement the order, dated 19.10.2016 passed in I.A.No.349 of 2016 in O.S.No.113 of 2016 on the file of the Hon'ble Junior Civil Judge, Nirmal, at the instance of the fourth respondent, and as such, seeks a direction to the respondents 1 to 3 to provide police protection. Considering the facts and circumstances of the case, the petitioner is directed to submit a representation to the third respondent seeking police protection to implement the order stated above, and on such representation, the third respondent is directed to consider the same and if the third respondent is of the view that there is necessity to give police protection for implementation of the order stated above, he is at liberty to do so. The writ petition is accordingly disposed of. Consequently, miscellaneous petitions, if any shall also stand disposed of. _____________________ JUSTICE RAJA ELANGO 10.11.2016 pln
