THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI Writ Petition No.15258 of 2007 ORDER:

This writ petition is filed seeking the following relief/s: 'To issue Writ, order or directrion more particularly one in the nature of Writ of Mandamus, declaring the impugned auction notification dated 09.07.2007 issued by the 3rd respondent proposing to conduct auction of the lands under the possession and enjoyment of the petitioners on 19.07.2007 as arbitrary, illegal, improper and against to the principles of natural justice and consequently set aside by directing the respondents herein to extend the lease for the period from 2007-2008 or alternatively refund the Maktha already paid by the petitioners for the year 20062007 which was waived by the 1st respondent in G.O.Ms.No.2711, dated 22.12.2006, and to grant such other relief or reliefs'. [Reproduced verbatim] The learned counsel for the writ petitioner submits that the cause in the writ petition does not survive for adjudication and that, therefore, the writ petition may be dismissed as infructuous.

Recording the said submission, the Writ Petition is dismissed as infructuous. There shall be no order as to costs. Miscellaneous petitions pending, if any, in this writ petition shall stand closed.
