THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI WRIT PETITION No.13328 OF 2018 ORDER:

This writ petition, under Article 226 of the Constitution of India, is filed, seeking a relief in the nature of writ of mandamus, to declare the action of the respondents 4 and 5 in interfering with the day-to-day life of the petitioner for settling financial transactions with a third party as illegal, arbitrary and contrary to the principles of natural justice and the provisions of the Indian Constitution.

I have heard the submissions of Sri Ch.Venkat Raman, learned counsel for the petitioner, and of the learned Government Pleader for Home (A.P.), appearing for the respondents. I have perused the material record.

At the hearing, learned Government Pleader for Home, on written instructions, a copy of which is placed on record, would submit that on the strength of the report given by one Janipireddy Subba Rayudu, a case in Crime No.180 of 2018 was registered against the petitioner herein, on 15.04.2018, by the Station House Officer, Ravulapalem Police Station for the offences punishable under Sections 447, 323 and 506 read with 34 I.P.C. and that thereafter, the petitioner surrendered before the Court of the learned Judicial First Class Magistrate, Kothapeta and was enlarged on bail, on 19.04.2018.

Learned counsel for the petitioner, while endorsing the said submissions, submits that the crime is registered after the writ petition is instituted.

Recording the submissions, the Writ Petition is disposed of directing the Investigating Officer not to call the petitioner to the police station except in connection with the investigation into the aforestated crime and that too without following the procedure established by law. There shall be no order as to costs. Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
