THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.44320 of 2016 ORDER:

The present writ petition is filed by the petitioner seeking to declare the action of the 3rd respondent in not giving police protection to the petitioner's shop No.30 and day to day business activities and not taking any action on the complaint of the petitioner, dated 15.12.2016, against respondents 4 to 6, as illegal and arbitrary and consequently, direct the 3rd respondent to take action on the complaint of the petitioner, dated 15.12.2016.

Heard and perused the material available on record. The main grievance of the petitioner is that the Station House Officer, Old Guntur Police Station, Guntur - 3rd respondent is not taking action on the complaint, dated 15.12.2016, made by the petitioner. Considering the grievance of the petitioner, without going into the merits of the case, this Court is inclined to pass the following order: The 3rd respondent is directed to take appropriate action on the representation, dated 15.12.2016, made by the petitioner before him, if it discloses any cognizable offence, and investigate into the same and file a final report, if any, in accordance with law, as expeditiously as possible.

If the petitioner is aggrieved over the action of the 3rd respondent, he is at liberty to approach the superior officer of the 3rd respondent and also to approach the concerned Court by invoking provision under Section 200 Cr.P.C. Accordingly, the Writ Petition is disposed of. No order as to costs. Consequently, miscellaneous petitions pending, if any, shall stand closed. ______________ RAJA ELANGO, J December 20, 2016.
