HONOURABLE SRI JUSTICE T. AMARNATH GOUD WRIT PETITION NO: 3 9 9 5 OF 2015 O R D E R :

This writ petition is filed challenging the action of the third respondent in interfering into the civil disputes between the petitioners and fourth respondent and also to direct the petitioner No.1 to cancel the gift deed dated 25/7/2011 in respect of Plot Nos. 23 to 44 and Plot Nos. 70 to 82 in survey No.156-3 situated at Rapthadu village and Mandal, Anantapuram district, without having any jurisdiction as illegal, arbitrary and consequently to direct the respondents not to interfere into the civil disputes between the petitioners and fourth respondent in any manner and to pass such other suitable orders as this Court may deem fit and proper in the circumstances of the case.

2. Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Home [Telangana].

3. Since it is a civil dispute and the petitioners are seeking the relief to direct the first petitioner to cancel the gift deed dated 25/7/2011 in respect of the above plots, this Court is not inclined to interfere in the subject matter and also cannot grant any direction. However, it is the contention of the petitioners that the Police are interfering in their peaceful possession and enjoyment of the property. On the basis of written instructions,

dated 10-3-2015, Sri A. Ramesh Babu, Assistant Government Pleader for Home submits that the respondents 2 and 3 are not interfering and the allegation made by the petitioners is false.

4. In view of the above submission made by the Assistant Government Pleader for Home, the writ petition is devoid of merits and the same is dismissed. No costs.

5. As a sequel, miscellaneous petitions, if any pending in this writ petition shall stand closed.
