This Writ Petition is filed seeking issuance of Writ of Mandamus declaring the action of the respondents in digging the land on the pretext of widening of tank without any standing orders and without disposing of the petitioner's appeal pending before the 2nd respondent in respect of the land of the petitioner an extent of Ac 2.00 cents in R.S.No.116 situated in Tupakulagudem Village of Tallapudi Mandal, West Godavari District, as illegal and arbitrary and consequently to direct the 2nd respondent to dispose of the appeal pending before him in respect of the above land.
The petitioner has filed documents to show that he is in possession of the land in question.
Learned Assistant Government Pleader states that the land in question is a water body and in view of the fact that the petitioner was in possession of the property, he cannot be evicted except by following due process of law.
