THE HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO Writ Petition No.13399 of 2017 ORDER:
The grievance of the petitioner hospital in the present Writ Petition is that the second respondent is interfering with its smooth functioning and ordered for closure of the hospital pending enquiry into the allegations made against it without following due process of law pursuant to registration of FIR No.49 of 2017 under Section 312 IPC and Sections 3 and 4 of the Medical Termination of Pregnancy Act, 1971.
It is submitted by the learned Counsel for the petitioner that on the oral orders of the second respondent, the hospital was closed and no written orders were passed.
Since the grievance of the petitioner hospital is with regard to the observance of rule of law, this Writ Petition is disposed of directing the second respondent to follow due process of law while taking any action against the hospital run by the petitioner pursuant to registration of crime.
As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed. There shall be no order as to costs.
