THE HONOURABLE SRI JUSTICE P. KESHAVA RAO WRIT PETITION No.19749 of 2011 ORDER:

Heard learned counsel for the petitioner as well as learned Government Pleader for Home.

The prayer sought in the writ petition is as under:- "....to issue a Writ, Order or direction, more particularly in the nature of Writ of Mandamus, directing the Respondent No.1 to investigate in Crime No.174/2010 lodged before Respondent No.1 Police Station and pass such other order or orders as this Hon'ble Court deems fit and proper in the circumstances of the case."

Learned counsel appearing for the petitioner would inform the Court that the parties have settled the matter outside the Court by way of entering into a compromise. However, respondent No.1 filed a counter-affidavit contended inter alia that on receipt of a private complaint forwarded to the Station House Officer, Charminar Police Station, Hyderabad city, a case in Crime No.174 of 2010, for the offences under Sections 466, 465, 473 and 471 IPC, was registered on the file of Charminar Police Station, on 14.07.2010. It is also further stated in the counter-affidavit that all the averments made in the affidavit filed in support of the writ petition are the subject matter of the investigation in Crime No.174 of 2010. It is further mentioned in the counter-affidavit that after completion of investigation, by following the due process of law, a final report under Section

173 Cr.P.C. was filed before the Chief Metropolitan Magistrate at Nampally, Hyderabad, on 27.07.2015, vide S.R.No.3841 of 2015. 4.

In view of the submission made by learned counsel for the petitioner and in the light of averments mentioned in the counteraffidavit filed by respondent No.1, this Court is of the opinion that no further cause would survive in the writ petition and the same is liable to be closed.

Accordingly, the writ petition is closed.

As a sequel, miscellaneous petitions pending, if any, shall stand closed. No costs.
