HONOURABLE JUSTICE G. SRI DEVI CRIMINAL REVISION CASE No.828 of 2019 ORDER:- 1.

The present Criminal Revision is filed under Sections 397 and 401 of Cr.P.C. questioning the order, dated 14.06.2019, passed in Crl.M.P.No.1371 of 2019 in C.C.No.59 of 2015 on the file of the Judicial First Class Magistrate at Alair.

The petitioner herein is facing trial in the aforesaid Calendar Case for the offences punishable under Sections 498-A IPC and Sections 3 and 4 of the Dowry Prohibition Act. On 15.03.2019, when the matter was posted for trial, the petitioner/ accused No.1 could not appear before the trial Court due to cancellation of leave granted to the soldiers by the Government of India. Seeing the absence of the petitioner, the trial Court issued non-bailable warrant against the petitioner. The petitioner filed an application under Section 70 (2) of Cr.P.C., seeking recall of warrant, which was rejected on 14.06.2019. Challenging the same, the present Criminal Revision Case is filed.

Heard both sides and perused the impugned order. 4.

Learned Counsel for the petitioner submits that the petitioner is working as CRPF Constable and he applied leave for attending the Court, but he could not attend the trial Court on the aforesaid date as the leave granted to the soldiers was cancelled by the Government of India. 5.

Having regard to the facts and circumstances of the case, the non-bailable warrant issued against the petitioner is recalled and the petitioner is directed to appear before the trial Court in connection with the above case within 30 days from today and on such appearance, the petitioner shall be released on bail on his executing a personal bond to a

tune of Rs.25,000/ - (Rupees twenty five thousand only) with two sureties for a like sum each to the satisfaction of the trial Court. 6.

Accordingly, the Criminal Revision Case is disposed of.

Consequently, miscellaneous petitions, if any, pending shall stand closed.
