THE HON'BLE JUSTICE G.SRI DEVI CRIMINAL PETITION No.4397 of 2019 ORDER:

This Criminal Petition, under Section 482 of Code of Criminal Procedure, 1973, is filed by the petitioner seeking to quash the order, dated 30.11.2018, passed in Crl.M.P.No.1284 of 2018 in Crime No.458 of 2018 by the II Additional Judicial Magistrate of First Class, Khammam.

Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor representing the respondent-State. Perused the record.

At the time when the matter is taken up for hearing, learned counsel for the petitioner seeks permission of this Court to withdraw the Criminal Petition with liberty to file an appropriate application before the authority concerned for release of the subject vehicle. 4.

Permission is accorded.

Accordingly, the Criminal Petition is dismissed as withdrawn granting liberty to the petitioner to file an application before the appropriate authority within a period of fifteen (15) days from today for release of the subject vehicle and thereafter, the appropriate authority shall consider the same and pass appropriate orders within a period of fifteen (15) days thereafter, in accordance with law, after giving due opportunity to the petitioner.

With the above direction, the Criminal Petition is dismissed as withdrawn.

Miscellaneous petitions, if any, pending in this criminal petition shall stand closed.
