HON'BLE SRI JUSTICE SURESH KUMAR KAIT CIVIL REVISION PETITION No.2461 of 2018 ORDER : (Oral) Vide the present petition, the petitioners seek directions thereby to dispose of A.S.No.49 of 2015 on the file of Senior Civil Judge, Sattenapalli, Guntur District, without further delay. 2.

As stated in the present petition, O.S.No.14 of 2010 filed by the respondents-plaintiffs was decreed on 21.11.2015. Being aggrieved, the petitioners herein filed A.S.No.49 of 2015 with I.A.No.2037 of 2015 for stay of decree dated 21.11.2015. Till date, the said I.A. has not been decided by the Court mentioned above, due to which, the petitioners have apprehension that the respondents may alienate the schedule property and the appeal filed by the petitioners would be frustrated.

It is further submitted by the learned counsel for petitioners that the Court below has heard the arguments of both sides and written submissions are also filed by both the parties. However, the Court mentioned above has not decided the appeal till date. 4.

Keeping in view the averments made in the instant petition and the submissions of counsel for petitioners, though the appeal is of 2015, however, as it is stated by the counsel for petitioners that arguments have been heard and written submissions are filed, I hereby direct the Senior Civil Judge, Sattenapalli to decide A.S.No.49 of 2015 within two months from receipt of this order.

I hereby made clear that if the submissions made by the counsel for petitioners before this Court are contrary to the record, then, the Court below has liberty to decide the appeal as per its convenience and as per seniority of the case.

Subject to above directions, the revision petition is disposed of. No order as to costs.
