THE HON'BLE SRI JUSTICE P. NAVEEN RAO Dated:18.04.2018 Between:

Kurva Govindu, S/o.Kurva Narsappa, Aged about: 48 years, Occ: Agriculture, Tuppathrala Village, H/o. Aiza Village Mandal, Jogulamba Gadwal District, Telangana and another ... Petitioners And State of Telangana, rep. by its Principal Secretary, Revenue Department, Telangana Secretariat, Hyderabad and others.

... Respondents The Court made the following:

THE HON'BLE SRI JUSTICE P.NAVEEN RAO ORDER:

Aggrieved by the action of the 4th respondent in not considering the request made by the petitioner to mutate his name in the revenue records to issue pattadar passbook and title deed in respect of land to an extent of Acres 3.01 cents in Survey No.814/B of 'Aiza or Ieeja' Village and Mandal, the present writ petition is filed.

2.

The facts on record and as mentioned in the representations submitted by the petitioner as early as on 20.05.2016 to the Revenue Divisional Officer, District Collector and Tahsildar would disclose that petitioner was aware that in the year 2007 itself the mutation was done in favour of another person and his name is reflected. That person is not even made a party to the writ petition. 3.

Once a mutation was already made in favour of the third party, way back in the year 2007, it cannot be said that the respondent authorities are negligent in not acting on the application made by the petitioner to mutate his name. Thus the relief as prayed for cannot be granted, however, leaving it open to the petitioner to work out his remedies as available in law and if so advised, aggrieved by the entries made in the

revenue records mutating third party's name in the subject land, this writ petition is dismissed.

4.

Miscellaneous petitions pending consideration, if any, in this case shall stand closed in consequence. No order as to costs.
