THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No. 4983 OF 2016

O R D E R

The prayer of the petitioner in this case is as under: "This Hon'ble Court may be pleased to issue a writ order or direction more particularly one in the nature of mandamus declaring the action of the 3rd respondent police people in interfering with the life and liberty of petitioner as illegal, arbitrary, in abuse of the authority vested, unconstitutional and violative of Article 21 of Constitution of India and be pleased to pass such other order or orders as deems fit and proper in the circumstances of the case."

The Sub Inspector of Police, Chanda Nagar Police Station, Cyberabad, furnished written instructions dated 22.03.2016 to the Office of the learned Government Pleader for Home, wherein he stated that upon the complaint made by one Sri Ajam Ali Sardar, Crime No.376 of 2016 was registered under Sections 380 and 457 I.P.C on the file of Chanda Nagar Police Station. The son of the petitioner was stated to be the accused in the said crime. As his whereabouts were not known, the Investigating Agency tried to obtain information as to where he was. The Sub Inspector of Police stated that only the son of the petitioner was required for interrogation and that the petitioner was not at all wanted in relation to the case. The Sub Inspector of Police also denied the allegation that the police authorities had ever interfered with the life and liberty of the petitioner.

In the light of the aforestated stand of the police authorities, it is clear that the petitioner is not required in the context of any criminal investigation. No adjudication is therefore warranted on merits in this case.

The writ petition is accordingly dismissed.

Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
