The petition coming on for hearing, upon perusing the Petition and the memo of grounds filed in the Crl.P. and upon hearing the arguments of SRI G V L MURHTY Advocate for the Petitioner, PUBLIC PROSECUTOR (TG) Advocate for Respondent, the Court made the following.

The petitioner-Al filed the present application under Sections 437 and 439 of the Code of Criminal Procedure, seeking to grant bail to him in Crime No. 285 of 2019 on the file of Narsingi Police Station, Cyberabad District, registered for the offences under Sections 498-4 and 306 lPC.

lt is alleged in the remand case diary that the sister of the defacto complainant i.e., wife of the petitioner/Al , has committed suicide by hanging herself in their house on 24.04.2019 due to harassment caused by the petitioner mentally and physically . 3.

Learned counsel for the petitioner/Al submits that the petitioner has not harassed the deceased for want of dowry as alleged and he supported her to pursue further studies. He further submits that the deceased was suffering from diseases and depression and without informing the same, the marriage was performed. He further submits that at the time of committing suicide by the deceased, nobody was present in the house and on depression only, she committed suicide, but not due to the i harassment of the petitioner. He further submits that the petitioner is in judicial custody since 26.06.2019 and that all the material I witnesses were examined and charge sheet has been filed and that the petitioner is ready to abide by the conditions imposed by this Court and he is ready of furnish sufficient sureties before the Court. !

Learned Additional Public Prosecutor vehemently opposed to grant bail to the petitioner/A'1 .

5. ln view of the nature of allegations levelled against the petitioner and since the charge sheet has already been filed, without adverting to the merits of the matter, this Court is inclined to grant bail to the petitioner on certain terms and conditions. 6.

Accordingly, the Criminal Petition is allowed and the petitioner/Al shall be released on bail on his executing a personal bond for a sum of Rs. 15,000/- (Rupees fifteen thousand only) with two sureties for a like sum each to the satisfaction of the XVI Additional lvletropolitan Magistrate, Cyberabad at Rajendranagar. Further, the petitioner/accused shall not indulge in any similar type of activities in future; shall not tamper with the prosecution witnesses and shall co-operate with the investigating agency; and shall not misuse the liberty granted to him. 7.

As a sequel, miscellaneous applications, if any pending, shall stand closed.
