This writ petition is filed under Article 226 of the Constitution of India for the following relief - " For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble Court may be pleased issue a Writ, Order, or direction more particularly one in the nature of Writ of Mandamus declaring the inaction of the respondents 3 & 4 in not registering the complaint of the petitioner dated 3.6.2015 made against the 5th respondent as illegal, arbitrary and against the principles of natural justice and consequently direct the respondents 3 and 4 to register a crime against the 5th respondent and handover the vehicle bearing No.AP-02-AF-1377 to the petitioner and pass such other other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case." When the matter is taken up for consideration, written instructions dated 13.8.2015 furnished by the Station House Officer, Uravakonda Police Station, Ananthapur District has
been placed on record by the learned Government Pleader for Home and the relevant portion of the same reads as under :
" It is respectfully submitted that one N. Munindra/the petitioner herein purchased one vehicle bearing No.AP-02-AF-1377 from B.Sanjeev Murthy by executing an agreement stating that he sold his car for Rs.2 Lakhs and he received Rs.1 lakh and handedover the car to the petitioner and remaining RS.1 lakh to be paid at the time of transfer of RC from and if not transferred the same he will be paid Rs.2/- interest to the same but he did not do the same and again sold the above said vehicle to one Shiv Shanker through finance from Sri Ram Chits. But the Shiv Shanker did not pay the instalments, hence one Narayana Reddy one of the partner of Sri Ram Chits seized the said vehicle on 23.3.2015, hence requested to take necessary action. Basing on the complaint a case was registered in Cr.No.84/2015 u/s.
383, 420 r/w 34 IPC of Uravakonda Police Station on 25.7.2015 by the then SHO. It is further submitted that now the Sub Inspector of Police Uravakonda taken his charge on 1.8.2015, and took up the investigation. During the course of investigation it reveals that the accused was absconding, hence efforts are being made to trace out the accused. The above said vehicle, after completion of investigation the respondent police will file appropriate report before the Hon'b e Court." Noticing the said instructions, learned counsel for the petitioner requests to dispose of the writ petition by recording the above written instructions dated 13.8.2015. In view of the above, the writ petition stands disposed of by recording the above written instructions dated 13.8.
2015 furnished by the Station House Officer, Uravakonda Police Station, Anantapur District. Miscellaneous applications, if any pending in the writ petition, shall stand closed. No costs.
