HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.5023 of 2017 ORDER:

In this petition filed under Section 482 Cr.P.C, the petitioner/ accused seeks to quash the proceedings in Crime No.370 of 2017 on the file of XI Metropolitan Magistrate, L.B.Nagar, R.R.District, which was registered for the offence under Sections 406, 420, 498A, 354, 109 IPC and Sections 3 and 4 of Dowry Prohibition Act. 2) When the matter came up for hearing, learned Public Prosecutor produced the letter dated 26.02.2018 of Sub-Inspector of Police, Saroornagar PS, Rachakonda Commissionerate and submitted that in this case in this case investigation was completed and charge sheet was filed and case was registered as PRC No.1/2018 on the file of XI Metropolitan Magistrate, L.B.Nagar and therefore, the petition which is filed to quash the proceedings in Crime No.370 of 2017 has become infructuous and hence the same may be dismissed. 3) Learned counsel for petitioner present and requested that liberty may be granted to him to challenge the charge sheet. 4) While dismissing the Criminal Petition as infructuous liberty as prayed for is granted.

As a sequel, miscellaneous petitions pending, if any, shall stand closed.
