THE HON'BLE SRI JUSTICE A. SHANKAR NARAYANA SECOND APPEAL No.1456 of 2012 JUDGMENT:

When the matter was called on 13.06.2017, there was no representation for the appellant and, having observed that for the past three consecutive adjournments, there was no representation for the appellant, Registry was directed to list the matter under the caption 'for dismissal'. Thereafter, on 14.06.2017, despite listing the matter under the caption 'for dismissal', a request was made by the learned counsel for the appellant to adjourn the matter and, therefore, it stood posted to this day.

Today also, there is no representation for the appellant. However, the respondents are represented by their counsel. Hence, the Second Appeal is dismissed for non-prosecution. There shall be no order as to costs.

Miscellaneous applications, if any pending in the instant appeal, stand closed.
