THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.13707 OF 2004 ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India seeking a Writ of Mandamus declaring the action of the respondents in not continuing the petitioner in service on par with regular employees and treating the petitioner as casual conductor as illegal, arbitrary, unjust and consequently direct the respondents to continue the petitioner in service as a regular employee in pursuance of the award of the Labour Court in I.D.No.259 of 2000, dated 09.01.2002.

The learned counsel for both parties with one voice submitted that the purpose of filing the writ petition has become infructuous. In view of the submission made by the learned counsel for both parties, the Writ Petition is dismissed as infructuous. No costs.

Consequently, Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
