HONOURABLE JUSTICE G. SRI DEVI CRIMINAL PETITION No.4409 of 2019 ORDER:
This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973, is filed by the petitioner/A3, seeking to grant anticipatory bail to him in Crime No.206 of 2019 on the file of Jagtial Town Police Station, Jagtial District, registered for the offence under Section 307 read with Section 34 IPC.

Heard learned counsel for the petitioner/A3, learned Additional Public Prosecutor representing the respondent-State and perused the record.

It is alleged in the remand case diary that on 18.06.2019 at 1045 PM., when the de-facto complainant went to Diamond Kirana Shop, some persons were quarrelling in front of the shop and as two accused were sat on the scooty, the owner of the shop requested them to leave the scooty as its stand would be broken, but they pelted stones on the de-facto complainant and the owner of the shop with an intention to kill them resulting bleeding injury on the head of the de-facto complainant. It is further alleged that one of the accused also attacked the de-facto complainant with a knife. 4.
Learned counsel for the petitioner/A3 submits that there are no allegations against the petitioner in the complaint and earlier, his name was also not mentioned. He further submits that basing on the confession of A1 and A2, the petitioner's name was implicated in the present crime. He further submits that the petitioner, who is a
Student of Hotel Management, has not committed any offence. Thus, he prays to enlarge the petitioner on anticipatory bail. 5.
In view of the nature of allegations leveled against the petitioner, this Court is not inclined to grant anticipatory bail to him. 6.
Hence, the Criminal Petition is dismissed. However, the petitioner is directed to surrender before the trial Court within 10 days from the date of this order and move an application for bail. On filing such application, the trial Court shall dispose of the same in accordance with law on the same day.

Miscellaneous applications, if any pending in this criminal petition, shall stand dismissed.
