Heard learned counsel for the petitioner and learned Government Pleader for Revenue appearing for respondents 1 to 3. 2.

Petitioner claims to be the owner of land to an extent of Ac.1.06 cents in Survey No.94/1 of Pakabanda Area, Khammam Town and District. She is aggrieved by inaction in conducting survey, even though several notices for conducting survey are issued.

It is seen from the record that the survey notices were issued on an application filed by respondent No.4 to conduct survey of land in Survey Nos.43 and 44, whereas the land of petitioner is in Survey No.94, though petitioner claims that this land is adjacent to Survey Nos.43 and 44. It is clear from the record and as fairly submitted by learned counsel for the petitioner that so far petitioner has not submitted application for conducting of survey. Learned counsel for petitioner is unable to explain as to why petitioner has not made application for conducting survey, if it is required, to properly demarcate her land. The Court is not inclined to grant the relief, as the petitioner has not made application for conducting survey. The person, who applied for conducting survey and on whose instance earlier survey notices were issued, is not prosecuting the issue. It is needless to observe that if petitioner wanted the survey to be conducted, she could have independently applied for conducting survey.

The Writ Petition is accordingly dismissed granting liberty to the petitioner to make application for conducting survey, if so advised. There shall be no order as to costs. Miscellaneous Petitions if any filed in this Writ Petition shall stand closed.
