THE HONOURABLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION NO.15746 OF 2019 ORDER:

Petitioner claims that he purchased land from Smt.Pusala Lalitha to an extent of Acs.2-31 1⁄2 guntas in survey No.210/A at Saidapur Shivar, Saidapur Grampanchayat limits of YadadriBhongiri District. It appears, before the said sale transaction, Smt.Pusala Laitha applied for lay out permission and said lay out permission is pending. Petitioner claims that lay out application ought not to have been kept pending for so long time.

2. Learned counsel for the petitioner submits that even though all the reports are available and the reports also reflect the name of the petitioner as the subsequent purchaser of the land, no action is taken in the matter.

3. Apparently from the material on record, petitioner has not made any application informing the Director of Town and Country Planning that he has succeeded to the said property and the layout application filed by his vendor is already pending.

4. Learned Government Pleader objects to the claim of the petitioner stating that he is not the applicant for layout application and the original applicant is not a party to the writ petition.

5. Having regard to these submissions, without expressing any opinion on merits, the petitioner is granted liberty to make an application to the 3rd respondent-The Director of Town and Country Planning with all supporting documents to show that he has succeeded to the property. Upon such application being made by the petitioner, the third respondent shall process the same,

appropriate decision be taken and communicated to the petitioner. This exercise shall be completed within a period of six weeks from the date of receipt of the application from the petitioner.

6. Accordingly, the Writ Petition is disposed of. Pending miscellaneous petitions shall stand closed. No order as to costs.
