HON'BLE SRI JUSTICE A.RAJASHEKER REDDY CONTEMPT CASE No.1006 of 2019 ORDER:
This Contempt Case is filed alleging willful disobedience of the order, dated 03.4.2018, passed by this Court in Writ Petition No.10885 of 2018. By the aforesaid interim order, this Court granted interim suspension of the impugned charge memo therein. Counter-affidavit is filed by the respondent, wherein it is inter alia stated as under:
"It is submitted that pursuant to the docket order dated 05.10.2018, the notice dated 05.10.2018 communicated vide Letter Dis.No.278, dated 19.10.2018 is issued which is only consequential step to the docket order. I respectfully submit that matter has been reopened by the docket order dated 05.10.2018 by the then III Member, Tribunal for Disciplinary Proceedings, Telangana, Hyderabad, pursuant to the circular issued by the Hon'ble High Court vide Roc.No.2573/OP Cell/20189 dated 18.4.2018. I respectfully submit that since I have no powers either to stop the proceedings or to continue the same, my functions are Ministerial in nature. I am supposed to dispose of functions as per the order of the Hon'ble Tribunal. However, on verification of records, I came to know that pursuant to the notice of the then III Member of the Tribunal dated 05.10.2018, no further steps have been taken up later by the succeeding III Member, Tribunal for Disciplinary Proceedings, Telangana."
Learned Assistant Government Pleader for Services-III submits that after this Court granted interim suspension of the impugned charge memo in Writ Petition No.10885 of 2018, no further steps are being taken by the respondent. The same is not disputed by the learned counsel for the petitioner.
Recording the above submission of the learned Assistant Government Pleader, the Contempt Case is closed. No order as to costs.
