HON'BLE SRI JUSTICE U.DURGA PRASAD RAO WRIT PETITION No.27502 of 2008 ORDER:

The petitioner seeks writ of Mandamus declaring the inaction of respondent in considering the application of petitioner for grant of pension under Swatantra Sainik Samman Pension Scheme-1980, as illegal, arbitrary and consequently direct respondent to consider the claim of petitioner for grant of pension under the aforesaid scheme. 2.

In W.P.M.P. No.36030 of 2008, this Court passed an interim order on 18.12.2008 directing respondent to consider the claim of petitioner for grant of pension under Swatantra Sainik Samman Pension Scheme1980. 3.

When the matter came up for hearing today, Sri Kowthuru Pawan Kumar, learned counsel for petitioner would submit, in view of the interim order, dated 18.12.2008, there is no requirement for passing final order in this writ petition and hence, the writ petition may be closed.

In view of above submission of learned counsel for petitioner, the writ petition is closed. No costs.

As a sequel, miscellaneous petitions pending if any, shall stand closed.
