HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO TRANSFER CRIMINAL PETITION No.154 OF 2015 ORDER:

This Criminal Petition is filed by the petitioners/accused under Section 407 Cr.P.C seeking to transfer C.C.No.253 of 2015 on the file of IV Metropolitan Magistrate, Ibrahimpatnam to any other Metropolitan Magistrate Court at Hyderabad. Heard the learned counsel for the petitioners and the learned Public Prosecutor (Telangana) for the State before notice to respondent No.2 and before admission. Perused the material on record.

There are no grounds to transfer C.C.No.253 of2015 for nothing shown within the purview of Section 407 Cr.P.C. so far as petitioners/accused are concerned. The only say is that all the accused persons are from Saroornagar, Hyderabad and to transfer the same to any place in Saroornagar District, that itself is not a ground to invoke Section 407 Cr.P.C. but for to say remedy is left open to the petitioners to apply Rule 37 of Criminal Rules of Practice before the learned Magistrate after notice to the Public Prosecutor concerned and the learned Magistrate shall hear and pass appropriate orders to dispense with the personal appearance of the petitioners but for one to represent others subject to conditions of personal appearance as and when required during trial.

Accordingly, this criminal petition is disposed of. Miscellaneous petitions pending if any, shall stand closed.
