THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.36347 of 2016 ORDER:
This writ petition under Article 226 of Constitution of India is filed to call for records pertaining to Crime No.96 of 2016. Heard and perused the material available on record. The case of the petitioners is that the petitioners were actively involved in student politics and due to political rivalry in student politics in the year 2009, the 5th respondent, who was then associated with Congress Party, along with his followers attacked the petitioners during the elections, in which the petitioners were injured and on a complaint given by the petitioners, Crime No.99 of 2009 was registered by the 4th respondent and the same was investigation and charge sheet was also filed and was numbered as C.C.No.28 of 2010, on the file of the Principal Junior Judge, Chilakaluripet.
The grievance of the petitioners is that the 5th respondent has lodged a false complaint before the 4th respondent, who registered the same as Crime No.96 of 2016 alleging that the petitioners attacked the 5th respondent in the mid night of 15.10.2016 and that the 5th respondent gave a complaint at 9.00 a.m. on 16.10.2016.
Considering the grievance of the petitioners, the 4th respondent is directed to complete the investigation in Crime No.96 of 2016 as expeditiously as possible and file a final report, if any, either way in accordance with law, without arresting the petitioners. The petitioners are directed to stay away from their native place from 07.11.2016 and they are directed to report before the 4th respondent daily at 10.00 a.m. from 23.11.2016 till completion of investigation.
Accordingly, the Writ Petition is disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition, shall stand closed.
