THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN Arbitration Application Nos.55 and 66 of 2017 COMMON ORDER:

The applicant in Arbitration Application No.55 of 2017 is the respondent in Arbitration Application No.66 of 2017 and viceversa. In both these applications reliance is placed on the same agreement, and appointment of an arbitrator is sought to resolve the disputes between the parties arising under the same agreement. As both the parties to the dispute have approached this Court seeking appointment of an arbitrator, it is wholly unnecessary for this Court to issue notice to the respondents as they are represented by their respective Counsel before this Court. The partnership deed dated 27.01.2016 contains an arbitration clause (Clause 15).

I consider it appropriate to appoint Sri Justice B. Seshasayana Reddy, Retired Judge of this Court, R/o.H. No.8-1-299/A/3, 1st Floor, Veterinary Colony, Opp: D.Mart, Shaikpet, Hyderabad - 500 089, as the sole arbitrator to resolve the disputes arising out of the subject partnership deed. The Learned arbitrator shall fix his remuneration, and incidental charges for the arbitration proceedings, in consultation with the parties. He is requested to complete arbitration proceedings, and pass an award at the earliest, preferably within a period of six months from the date of commencement of arbitral proceedings. He is also requested to hold sittings, as far as possible, in the mediation centre of the High Court.

Both the Arbitration Applications, are accordingly, disposed of. The miscellaneous petitions pending, if any, shall also stand disposed of. There shall be no order as to costs.
