M/S Vijaya Nagar Colony Residents Welfare Association v. The State Of Andhra Pradesh,
THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION NO.17870 OF 2017 ORDER:
Heard the learned counsel for the petitioner. None appeared for the fifth respondent in spite of service of notice on him.
The petitioner states that it is a registered society for the benefit of the students of Vijaya Nagar Colony. While so, the members of the society observed constructions of the fifth respondent in plot No.67 situated at Bangalore Road, Vijaya Nagar Colony, Anantapur Town, with a view to erect a church without obtaining any permission. The petitioner submitted a representation on 18.12.2014 to respondents 3 and 4 requesting to bring the matter to the notice of the District Collector and stop the construction erected out by the fifth respondent. As no further action was taken in spite of another representation of the petitioner dated 21.04.2017, the present Writ Petition was filed.
In view of the limited grievance of the petitioner, the third respondent is directed to take further action pursuant to the representation submitted by the petitioner after issuing notice to the petitioner as well as the fifth respondent in accordance with law within three (3) months from the date of receipt of a copy of this order.
Accordingly, the Writ Petition is disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, pending shall stand closed.
