HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION Nos.23203 AND 23223 OF 2017 COMMON ORDER:

These two writ petitions are being disposed of by this common order after hearing the learned counsel for petitioner and learned Government Pleader for respondents.

In these two writ petitions, the order of the second respondent dated 30.06.2017 directing the third respondent to dispose of the fertilizer/seeds was challenged. Admittedly, the proceedings under Section 6-A of the Essential Commodities Act are pending before the competent authority. Pending disposal of the said proceedings, the impugned orders were passed by the second respondent.

Learned counsel for the petitioner submits that the petitioner is willing to furnish Bank Guarantee for the value of the goods now sought to be disposed of by the impugned proceedings.

In the circumstances, these two writ petitions are disposed of by setting aside the impugned orders and releasing the seized stock to the petitioner on condition of the petitioner furnishing Bank Guarantee to the value mentioned in the impugned orders. As and when such Bank Gaurantee is furnished by the petitioner, the stocks, which are proposed to be sold, shall be released to the petitioner. The writ petitions are accordingly disposed of. Consequently, miscellaneous petitions pending, if any, in these two writ petitions, shall stand closed.
