THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CIVIL MISCELLANEOUS APPEAL No.194 OF 2017 JUDGMENT:
This appeal is filed under Order XLIII Rule 1 of C.P.C. challenging the order dated 05.01.2017 in I.A.No.1906 of 2016 in A.S.No.290 of 2016 on the file of the XXV Additional Chief Judge, City Civil Court at Hyderabad.
At the time of arguments, the only relief sought by the learned counsel for the appellants is to direct the appellate Court to dispose of the matter as expeditiously as possible, in view of the condition of the disputed wall.
In view of the submission made by the learned counsel for the appellants, this Court is not inclined to go into the merits of the main case.
Having regard to the facts and circumstances of the case and also the submission made by the learned counsel for the appellants, the learned XXV Additional Chief Judge, City Civil Court at Hyderabad, is hereby directed to dispose of A.S.No.290 of 2016, as expeditiously as possible, preferably by the end of July, 2017.
With the above direction, the Civil Miscellaneous Appeal is disposed of. There shall be no order as to costs.
