O R D E R

The case of the petitioner is that he is the retired employee and the resident of Gandhi Nagar/Gokul Nagar, Hanamkonda, Wardangal District. While so, the 2nd respondent started constructing a house in the same locality occupying a part of 30' road on southern side and without leaving any set backs on the 80' road towards the western side due to which the said roads have become congested causing inconvenience to the residents of the locality. Though the same was brought to the notice of the 1st respondent by the petitioner vide representations dated 01.10.2012, 04.10.2012 and 17.10.2012 and also by adjacent plot owners, the 1st respondent authorities neither initiated any action for removal of illegal construction made by the 2nd respondent nor have issued any notice to the 2nd respondent. Aggrieved by the same, the present writ petition is filed.

Heard the learned counsel for the petitioner; Smt Pingali Lakshmi, learned Standing counsel for 1st respondent-Corporation and Smt Naga Vani Prasoona, learned counsel for respondent No.2 Since it is for the 1st respondent to consider the representations of the petitioner regarding illegal constructions made by the 2nd respondent by encroaching the public road, I deem it appropriate to direct the 1st respondent to consider the representations of the petitioner and dispose of the same in accordance with law after issuing notice to the petitioner and 2nd respondent within a period of two (2) weeks from the date of receipt of copy of this order. With the above direction, the writ petition is disposed of. No costs.
