HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No. 12793 of 2012 Order:
Heard learned counsel for the petitioners and the learned Standing Counsel for the first respondent. In spite of service of notice on the second respondent none appeared.
It is the case of the petitioners that a boundary public road admeasuring Ac.4.70 cents covered by Survey No.111 of Pernamitta revenue village exists and serves as a passage to the public and land owners of Ongole, Mukthinuthalapadu and Pernamitta revenue villages. The petitioners and others own house sites adjoining such public road in Survey No.112 of Pernamitta revenue village. The first petitioner purchased an extent of 147.33 sq. yards under a registered sale deed and the second petitioner purchased 153.33 sq. yards under another registered sale deed. The second respondent started constructing a cement brick wall across the said road by blocking the passage. In those circumstances, they submitted a representation on 20.03.2012 to the first respondent as well as to the District Collector, Revenue Divisional Officer, Tahsildar and Panchayat Secretaries of Mukthinuthalapadu and Pernamitta Gram Panchayats. When the said representation was not considered, the present Writ Petition was filed.
Even after four years, no counter affidavit is filed by the first respondent.
In the circumstances, the Writ Petition is disposed of directing the first respondent to consider the representation of the petitioners dated
20.03.2012 and pass appropriate orders thereon within a period of eight
(8) weeks from the date of receipt of a copy of this order. There shall be no order as to costs.
As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
