HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.4994 OF 2009 ORDER:

Heard learned counsel for the petitioner and the standing counsel.

The petitioner prays for Mandamus to declare the action of respondents in retiring the petitioner from service with effect from 31.07.2010 as illegal and arbitrary, and consequently direct the respondents to continue the petitioner in service up to 31.07.2016. The standing counsel, on instructions, submits that the petitioner was subjected to Medical Board for determination of petitioner's age.

The Medical Board has opined that as on 16.08.2010, the petitioner was 60 years. The Medical Board has determined the age of petitioner. I am of the view that the petitioner, if aggrieved by the determination of age by Medical Board, he has to work out the remedies against such proceedings. The prayer at this stage cannot be considered.
