Smt. Doli Devamma, v. The Mandal Revenue Officer,
THE HONOURABLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION No.12073 OF 2012 O R D E R :
Heard counsel for the petitioner and the Government Pleader for Revenue appearing for respondents 1 to 3.
2. Counsel for the petitioner contends that the petitioner, who belongs to Schedule Caste Community, has been assigned Acres 5-00 guntas of land in survey No.651 of Achulapur Village, Tandur Mandal, Adilabad District in 1995; that pattadar passbook and title deeds have also been issued to her; but since there is some uncertainty about the boundaries of the assigned land, the respondents 4 to 12 are attempting to encroach into the said land. Counsel for the petitioner therefore prays that the respondents 1 to 3 be directed to cause survey and fix the boundaries to the land assigned to the petitioner.
3. The Government Pleader for Revenue appearing for respondents 1 to 3 states that respondents 1 to 3 will cause survey to be conducted in respect of the subject land and fix boundaries thereto under the provisions of the A.P. Survey and Boundaries Act, 1923 after issuing notice to all the interested parties.
4. In view of the said submissions, this Writ Petition is disposed of directing the respondents 1 to 3 to cause survey and fix boundaries to the extent of Acres 5.00 guntas of land
in survey No.651 of Achulapur Village, Tandur Mandal, Adilabad District, assigned to the petitioner in 1995, within a period of three (03) months from the date of receipt of a copy of this order, after issuing notice to all the affected parties. Depending on the result of the said survey, it is open to the petitioner to take appropriate action against respondents 4 to 12 in accordance with law. There shall be no order as to costs.
5. Consequently, miscellaneous petitions pending, if any, shall stand dismissed.
