THE HON'BLE SRI JUSTICE C.V.NAGARJUNA REDDY COMPANY PETITION No.43 of 2015 09.06.2015 Between:

The Tata Power Company Limited

...Petitioner

And S.V.Power Private Limited

...Respondent

Counsel for the Petitioner: Ms.Kajal Kumari for Ms.Shireen Sethna Baria Counsel for the respondent: none appeared The Court made the following:

ORDER:

This company petition is filed for an order to wind up the respondent for nonpayment of the debt, allegedly, due to the petitioner. At the hearing, Ms.Kajal Kumari, learned counsel representing Ms.Shireen Sethna Baria, learned counsel for the petitioner, submitted that the respondent has paid the debt. However, she requested for an adjournment for filing a memo to this effect. In my opinion, filing of a memo is unnecessary when there is no dispute about payment of the debt and the company petition is not admitted. In view of the above circumstances, the Company Petition is dismissed as infructuous as the dispute is settled out of Court. __________________________ (C.V.NAGARJUNA REDDY, J) 09th June, 2015 GHN
