ORDER:

Pending revision petition filed by the private respondents and other cardholders before respondent No.1, the latter stayed the operation of the order of respondent No.2 passed in favour of the petitioner in an appeal filed by the latter. Feeling aggrieved by the said order, the petitioner filed the present writ petition. This Court, by interim order, dated 05.12.2011, suspended the impugned order of respondent No.1. Nearly four years thereafter, the writ petition is posted today. In my opinion, when the revision petition filed against the order of respondent No.2 passed in the appeal filed by the petitioner is pending before respondent No.1, it is appropriate that the said respondent disposes of the said revision petition expeditiously. As the order passed by him staying the order of respondent No.2 is suspended by the aforesaid interim order of this Court and this suspension order is continuing thus far, it is desirable that the petitioner shall be continued as the fair price shop dealer till the disposal of the revision petition by respondent No.1.

The Writ Petition is accordingly disposed of with the direction to respondent No.1 to dispose of the revision petition within a period of two months from the date of receipt of a copy of this order, after notice to the petitioner and respondent Nos.5 to 9. Respondent Nos.3 and 4 are further directed to continue the petitioner as the fair price shop dealer till the disposal of the revision petition by respondent No.1. As a sequel to disposal of the writ petition, W.P.M.P.No.39767 of 2011 filed by the petitioner for interim relief shall stand disposed of. __________________________ C.V.NAGARJUNA REDDY, J 03rd September, 2015 GHN
