This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973, is filed by the petitioner/ A.3, for grant of anticipatory bail in Crime No.128 of 2019 of Kulsumpura Police Station, Hyderabad, registered for the offences punishable under Sections 406, 420, 506 and 509 of IPC and Section 5 of T.S. Protection of Depositors of Financial Establishment Act, 1999.

Heard learned counsel for the petitioner/ A.3, learned Additional Public Prosecutor representing the respondent/ State and perused the record.

The case of prosecution, in brief, is that on 08.07.2019, the de facto complainant lodged a complaint alleging that the petitioner/ A.3 along with other accused was running Sri Kalimata Chit fund company and she joined as a member for Rs.2,50,000/ - from September, 2017 and paid the amount for 15 months and when she lifted the chit in the month of December, 2018, A.1 promised to pay the amount, but failed to do so. Thereafter, in the month of February, 2019, A.1 gave a cheque bearing No.10019659 for Rs.6,23,000/ -, which included the Dhanraj chit amount and came to know that the said cheque was dishonoured. When she along with her son and other members visited the house of the petitioner, he abused them in filthy language and threatened with dire consequences. Hence, the aforesaid case was registered against the petitioner.

Learned counsel for the petitioner/ A.3 would submit that the petitioner is no way connected with the aforesaid case; that he is not having any chit business; and that he has not cheated the de facto complainant. The entire investigation has been completed. Hence, he prayed to grant anticipatory bail to the petitioner. 5.

Learned Additional Public Prosecutor representing the respondent-State opposed to grant bail to the petitioner/ A.3. 6.

Having regard to the nature of allegations levelled against the petitioner/ A.3, this Court is not inclined to grant bail to the petitioner/ A.3.
