Judgment: (per Hon'ble Sri Justice C.V.Nagarjuna Reddy) This Appeal by the State is filed against Award and Decree, dated 19-08-2003, in OP.No.37 of 1993 on the file of the Principal District Judge, Medak at Sangareddy District. By the aforementioned award, the Court below has enhanced the compensation of Rs.20,000/- per acre, as fixed by the Land Acquisition Officer, to Rs.10/- per square yard after deducting 1/3rd of the market value towards conversion of the land into plots.
A perusal of the award of the lower Court shows that while enhancing the market value, it has placed reliance on Ex.A.1- certified copy of Common Judgment in OP.No.784 of 1992 and batch on the file of the Additional District Judge, Medak at Sangareddy District.
At the hearing, the learned Government Pleader for Appeals (TS) fairly submitted that the Judgment under Ex.A.1 has attained finality. He has also not disputed the fact that the lands covered by OP.No.784 of 1992 and batch and those involved in the present case are similar in nature, potentialities and value.
In the light of the above facts, we are of the opinion that the award under Appeal passed by the lower Court based on Ex.A.1- Common Judgment is proper and correct and the same is not liable to be interfered with in this Appeal. The Appeal is, accordingly, dismissed.
