THE HON'BLE SRI JUSTICE A. RAJASHEKER REDDY CIVIL REVISION PETITION No.1536 of 2010 ORDER:

This Civil Revision Petition is filed against the order, dated 11-02-2010 passed in E.P.No.19 of 2010 in O.S.No.48 of 2006, wherein the Court below attached the immovable property of the petitioner for non-payment of decretal amount in O.S.No.48 of 2006.

This Court granted interim stay on 16-04-2010 for a period of ten (10) weeks. Thereafter the stay was not extended.

Learned counsel for the petitioner submits that some reasonable time may be granted to the petitioner for payment of the decretal amount to the respondent/decree holder. Learned counsel for the respondent also stated no objection for the same.

A perusal of the impugned order goes to show that Court below passed orders after considering pleas of both sides. Learned counsel for the petitioner was not able to point out any infirmity in the impugned order.

Since the decree is of the year 2009 and there is no stay till date and in view of the submission of learned counsel for the respondent, the Civil Revision Petition is liable to be

disposed of granting time to the petitioner for payment of decretal amount.

In view of the above facts and circumstances, the Civil Revision Petition is disposed of, granting three (3) months time to the petitioner/judgment debtor for payment of entire E.P. amount to the respondent/decree holder. Failing which the impugned order revives and it is open for the respondent/decree holder to execute the same, in accordance with law and the Court below also directed to proceed with the matter without further reference to this Court. There shall be no order as to costs.

The Miscellaneous Petitions, if any, pending in this Civil Revision Petition shall stand closed.
