THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.19702 OF 2017 ORDER:

This writ petition is filed seeking to issue a writ of mandamus to declare the action of the respondents 2 and 3 in not taking action to prevent the illegal and unauthorized constructions over the road nearby Ambedkar Chowrastha, Bhupalpally, as illegal and arbitrary, and consequently, direct the 2nd respondent to prevent the illegal constructions over the area earmarked for road in front of the petitioners' property situated at Subhash Colony road, near Ambedkar Chowk, Bhupalpally village.

Heard and perused the material available on record. The case of the petitioners is that they are absolute owners and possessors of their respective house properties situated at Subhash Colony Road, near Bus Stand, Ambedkar Chowk, Bhupalpally Mandal and District. They have constructed dwelling houses and are residing in the said houses. In the year 1999, the 3rd respondent has acquired land for the purpose of developing a Township and also for formation of 200 ft., road. Recently, some unknown persons are making efforts to raise unauthorized constructions over the area earmarked for the road, without there being any permission from the 2nd respondent. The petitioners made several representations to the 2nd respondent authorities, but no action has been taken so far. Considering the nature of the grievance of the petitioners, the 2nd respondent is directed to act upon the representations made by the petitioners and if the allegations made by the petitioners are true,

necessary action shall be initiated against the unauthorized constructions.

Subject to the above, the writ petition is disposed of. No order as to costs. Miscellaneous petitions, pending if any, shall stand closed. ______________ RAJA ELANGO, J June 19, 2017 KTL
