Mohammed Saleem, S/O Late Mr.Mohammed Iqbal, v. The Secunderabad Cantonment
HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.20850 OF 2016 ORDER:
The case of the petitioners is that they are running meat shop in premises No.34, in GLR survey No.658/106, admeasuring 658 Square Feet, situated at Mudfort Bazaar, Ward No.3, Secunderabad Cantonment and the same was seized on 27.08.2015 by the respondent Board. Thereafter, petitioners made representation to the respondent Board along with all the relevant documents on 07.09.2015 seeking release of the shop from seizure. There upon the respondent Board vide order dated 05.01.2016 removed the seal and the petitioners are carryout out their business in the said shop. While so, on 21.06.2016 the respondent officials tried to dispossess the petitioners. Aggrieved by the same present writ petition is filed.
Heard learned counsel for the petitioners.
Sri K.R.Koteswara Rao, learned Standing Counsel for the respondent Board submits that under the guise of running mutton shop, the petitioners are trying to encroach other government lands, as such, the officials of the respondent removed the unauthorized structures made by the petitioners in the Government land. It is also submitted that as far as petitioners' shop is concerned, the respondent Board is not interfering with the same.
Recording the aforesaid submission made by the learned Standing Counsel for the respondent Board, the writ petition is disposed of. No order as to costs. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
