HONOURABLE SRI JUSTICE S.V. BHATT COMPANY PETITION No.335 OF 2015 O R D E R:

The petitioner seeks winding up of respondent company. The alleged debt by reference to which the instant company petition is filed is for a sum of Rs.2,70,000/-. During the pendency of the company petition, the respondent has paid a sum of Rs.1,00,000/- and the counsel appearing for the petitioner, on instructions, acknowledges the receipt of the said Rs.1,00,000/-. The balance payable as on date is Rs.1,70,000/-. The memo signed by respondent as well as its counsel dated 09.06.2016 is filed and reads as follows: "The respondent respectfully submits that an amount of Rs.1,00,000/- (Rupees One Lakh only) was paid to the petitioner by way of Demand Draft.

The respondent undertakes to pay the balance principal amount claimed by the petitioner, within a period of Eight (8) Weeks from today."
