THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.23632 OF 2016 ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India seeking a Writ of Mandamus declaring the action of respondent No.6 in issuing permission to construct grave yard in general format as house construction format vide No.176 dated 24-05-2016 without following due process of law and in the application not mentioned survey number and place of construction and the said application received by respondent No.6 office on 24-05-2016 and permission granted on same day i.e 24-05-2016 and further not followed procedure contemplated in Panchyat Raj Act, 1994, not taken medical clearance certificate from concerned medical department and gave permission in residential area is illegal, arbitrary and consequently to direct the official respondents to take appropriate action against the unofficial respondent.

The learned counsel for the petitioners submitted that respondent No.5 issued a notice to respondent No.8 on 06.07.2016 directing it not to make any further constructions. He further submitted that in view of the notice dated 06.07.2016 issued by respondent No.5, no further orders are necessary in this writ petition. In view of the submission made by the learned counsel for the petitioners, the Writ Petition is closed. No costs. Consequently, Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
