THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.4962 OF 2016 ORDER:

This petition is filed by the petitioners-A1 to A3 under Section 482 Cr.P.C. seeking to quash the proceedings against them in C.C.No.1119 of 2014 on the file of the XVII Additional Chief Metropolitan Magistrate, Hyderabad.

Heard and perused the material available on record. The petitioners are alleged to have committed the offence punishable under Sections 448, 323 and 506 IPC. It is alleged that there are disputes between the owner of the complainant and the accused. The accused are threatening the complainant as he is sending rents to the original owner. The accused are abusing him and co-tenants in filthy language. A4 came to the premises of the complainant on 14.9.2014 and attacked him with sticks. When the complainant pushed A4 in order to escape from the blows, A4 fell on a window and sustained injury. The accused beat the complainant. Learned Counsel for the petitioners submitted that the 2nd respondent came to the house of the petitioners and abused them in filthy language and beat one B. Chandrakanth Rao causing severe injuries and the said injured lodged a complaint against the 2nd respondent and the same was registered as a case in Crime No.894 of 2014 and that the 2nd respondent bore grudge against the petitioners and filed a false complaint.

Considering the facts and circumstances of the case, this Court is not inclined to interfere with the proceedings in the above C.C. However, the presence of petitioners 2 and 3 before the trial Court is dispensed with except on the date of framing of charges, on the date of their examination under Section 313 Cr.P.C. and on the date of pronouncement of judgment. Petitioners 2 and 3 are directed to be represented through a Counsel before the trial Court on all hearing

dates.

Accordingly, the Criminal Petition is disposed of. Consequently, miscellaneous petitions pending, if any, shall stand closed. ______________________ JUSTICE RAJA ELANGO Date : 11.4.2016 Nn
