This Criminal Revision Case is filed under Sections 397 and 401 Cr.P.C. challenging the order, dated 10-08-2016 in Crl.M.P.No.1092 of 2016 on the file of the Principal Sessions Judge, Kurnool.

Heard the learned counsel for the petitioners. 3.
A perusal of the record reveals that the petitioners herein, who are A1 and A2 were found guilty for the offence punishable under Section 411 IPC in C.C.No.317 of 2014 on the file of the Judl. Magistrate of I Class, Yemmiganur, and accordingly, they were convicted and sentenced to undergo simple imprisonment for a period of six months and also to pay a fine of Rs.1,000/- in default to undergo simple imprisonment for a period of one month.

Aggrieved by the judgment of the trial Court, the petitioners herein filed CFR No.755 of 2016 in Crl.A.No. of 2016 on the file of the Principal Sessions Judge, Kurnool. There is a delay of 80 days in representing the Criminal Appeal before the Sessions Court. The Principal District and Sessions Judge, Kurnool, dismissed the said petition as there was no representation on behalf of the petitioners. Hence, this revision.

Having regard to the facts and circumstances of the case, I am inclined to condone the delay of 80 days in representing the Criminal Appeal.

Accordingly, the Criminal Revision Case is allowed condoning the delay of 80 days in representing the Criminal Appeal. The Principal District and Sessions Judge, Kurnool is hereby directed to number the Criminal Appeal, if it is
