HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO W.P.No.38056 of 2015 ORDER:

Heard Sri L. Ravichandar, learned counsel for the petitioners and the learned Government Pleader for Revenue appearing for respondents.

2. Petitioners assail the proceedings dt.24-082015 of 3rd respondent rejecting petitioners' application to grant permission for development of the subject land on the ground that he is not competent authority to deal with the said application and 2nd respondent is the competent authority to do so.

Learned Government Pleader for Revenue has placed before me proceedings issued by 2nd respondent wherein 2nd respondent has differed with the view of 3rd respondent and stated that the only 3rd respondent is competent to take action on the request made by petitioners and not 2nd respondent.

In view of the proceeding issued by 2nd respondent, the impugned order dt.24-08-2015 passed by 3rd respondent is set aside and the matter is remitted back to 3rd respondent to consider afresh in the light of the above proceedings dt.22-01-2016 issued by 2nd respondent within six weeks from the date of receipt of a

copy of this order. The 3rd respondent shall inform his decision to the petitioners within the said period.

5. Accordingly, the Writ Petition is disposed of. No costs.

As a sequel, the miscellaneous petitions, if any pending, shall stand closed.
