This Criminal Petition is filed praying this Court to enlarge the petitioner on bail who is arrayed as accused No.2 in Crime No.622 of 2025 before the RPS Secunderabad Police Station registered for the offence punishable under Sections 8c read with 20(b)(ii)(C) and 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short 'the NDPS Act').

The allegation against the petitioner/Accused No.2 is that himself along with other accused were found in possession of 44.854 Kgs of Ganja and the same was seized from their possession.

Heard Sri Khaja Arajuddin, learned counsel representing Mr.Mohammed Ghouse Pasha, learned counsel for the petitioner and Sri M. Vivekananda Reddy, learned Assistant Public Prosecutor appearing on behalf of the respondent - State. 4.

Learned counsel for the petitioner submitted that the petitioner is innocent and has been falsely implicated in the present case. He contended that the petitioner is in judicial custody since 18.12.2025 and he is suffering from ill-health. Therefore, he prayed the Court to grant bail to the petitioner by allowing this Criminal Petition.

Learned Assistant Public Prosecutor opposed the bail application contending that the allegations against the petitioner are serious in nature involving offences under the NDPS Act and that the petitioner was arrayed as Accused No.2. He further submits that investigation is not yet completed in this case. Therefore, he prayed the Court to dismiss the criminal petition.

On considering the submissions made by both the learned counsel and on perusing the material available on record, this Court is of the view that the quantity involved in the present case is 44.854 kgs of Ganja, which is commercial quantity as per Section 37 of the NDPS Act. In view of rigor of Section 37 of

the NDPS Act, this Court is not inclined to grant bail to the petitioner. Therefore, the criminal petition lacks merit and the same is liable to be dismissed.

Accordingly, this Criminal Petition is dismissed. Miscellaneous applications, if any, pending in this petition, shall stand closed.
