Shok Kumar Agarwal, Hyderabad v. M.A. Myneem Khan, Hyderabad
THE HON'BLE SMT JUSTICE T.MEENA KUMARI C.R.P No.4156 of 2009 ORDER:
This Civil Revision Petition is directed against the order dated 22.07.2009 passed in R.A.No.145 of 2008 by the Chief Judge, City Small Causes Court, Hyderabad, wherein the learned Chief Judge, dismissed the appeal while confirming the order dated 14.07.2008 passed in R.C.No.345 of 2005 by the learned II Additional Rent Controller, Hyderabad and granted two months time to vacate the premises and directed to hand over possession of the same to the respondent-landlord.
When the matter is taken up for hearing before this Court, learned counsel for the revision petitioner submitted across the Bench that the petitioner undertakes to vacate the petition schedule premises within the time as stipulated by the Court and also undertakes to pay the rents regularly till the date of vacation of premises and an affidavit of the petitioner is also filed to that effect. In view of the above undertaking, it would suffice if a direction is given to the revision petitioner that he shall vacate the petition schedule premises on or before 31st July, 2010 and hand over vacant possession of the premises to the respondent-landlord and shall continue to pay the rents till the date of vacation of the premises. With the above direction, the Civil Revision Petition is dismissed.
