HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.37071 of 2016 ORDER:

This writ petition is filed by the petitioners under Article 226 of the Constitution of India seeking to direct the 2nd respondent to issue FIR against respondents Nos.3 and 4.

Heard and perused the material available on record. 3.

The main grievance of the petitioners is that respondents Nos.3 and 4 filed a suit with forged documents against the petitioners in respect of the subject land and further, they are not allowing the petitioners for cultivating the subject land. The petitioners made an application to the 2nd respondent for taking action against respondents Nos.3 and 4. But no action was taken so far.

Considering the circumstances of the case and the grievance of the petitioners, without expressing any opinion on merits, the Writ Petition is disposed of with the following direction:

"Respondent No.2 is directed to register the complaint, if any lodged by the petitioners and if it discloses any cognizable offence, and proceed in accordance with law. If the above respondent fails to register the complaint, the petitioners are at liberty to avail the remedies that are available under law." There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
