M/S B.N.R. Constructions v. The State Of Telangana
THE HON'BLE SRI JUSTICE MUMMINENI SUDHEER KUMAR WRIT PETITION No.21895 of 2022 ORDER:
Heard learned counsel for the petitioner and learned Assistant Government Pleader for Revenue appearing for respondents 1 to 5. With their consent, the writ petition is disposed of at the stage of admission.
2.
Perusal of the record shows that questioning the very same impugned proceedings, which is impugned in this writ petition, W.P.No.14078 of 2020 was filed before this Court and the same pending consideration. The petitioner herein is claiming his rights through the petitioner in the said writ petition. Further, the impugned proceedings are arising out of the original proceedings No.D/7790/2005, dated 05.01.2006, and D/7791/2005, date 05.01.2006. The petitioner claimed to have purchased the subject land through the registered sale deeds, dated 19.09.2007, which are subsequent to the passing of the original proceedings, dated 05.01.2006. 3.
In view of the same, as the petitioner is claiming his rights through the petitioner in previous writ petition i.e., W.P.No.14078 of 2020 and further the petitioner is a purchaser
after the issuance of original proceedings in the year 2006, this Court is not inclined to entertain this writ petition, at the instance of the petitioner herein, which is nothing but multiplication of litigation.
4.
The writ petition is accordingly dismissed granting liberty to the petitioner to pursue his remedies in accordance with law, including filing of an implead application in the pending writ petition.
Miscellaneous Petitions, if any, pending in this writ petition shall stand closed.
